Keep Case

A millionaire is found dead of heart failure handcuffed to the bed with a home video tape of him and his lover. When cocaine is found in his system, and his will leaves $8 million to his lover, they arrest her on suspicion of murder. Her lawyer succumbs to her charms, and he begins a torrid and kinky affair with her. As new evidence turns up during trial, he begins to wonder if he's defending a murderer.
Written by Ed Sutton

Elderly Andrew Marsh is found dead in his bed in what looks to be murder, as a non drug using Andrew was found with cocaine in his system, which exacerbated the medical issues surrounding his heart condition. Rebecca Carlson, Andrew's much younger girlfriend, is on top of the suspect list. She hires a lawyer, Frank Dulaney, before she is even questioned or charged by the police. But she is eventually charged. Key to the case is motive, with Rebecca standing to inherit Andrew's $8 million fortune (which she states she being named his primary beneficiary she knew nothing about). The case also stands on Rebecca and seemingly Andrew's "aggressive" sexual behavior, which included BDSM, with most believing that Rebecca was trying to "screw" him to death. This brings into question Rebecca's past relationships, as well as the behavior of those around Andrew, such as his personal secretary Joanne Braslow, who would like to see Rebecca convicted more than anything. As Frank begins to work on the case, he gets lured into Rebecca's seduction and the thought of entering into the world of BDSM with her, despite he being happily married. This personal relationship with his client provides additional motivation to help her get acquitted, which he feels is his job anyway despite her guilt or innocence.

SYNOPSIS

An older man, Andrew Marsh, is seen viewing a homemade pornographic tape. It is later revealed the man died from complications stemming from erotic asphyxiation. The main suspect is the woman having sex with Marsh in the film, Rebecca Carlson (Madonna), who after being charged with murder is represented by lawyer Frank Dulaney (Willem Dafoe).

The trial begins in Portland, Oregon and it isn't long before Rebecca and Frank enter a sadomasochistic sexual relationship behind the back of Dulaney's unsuspecting wife (Julianne Moore). Their rough sex goes so far that Rebecca drips hot candle wax onto Frank.

Rebecca proclaims her innocence to Frank in private as well as in court, but the prosecutor and district attorney Robert Garrett (Joe Mantegna) is out to prove that Rebecca Carlson deliberately killed Marsh in bed with sex to receive the $8 million he left her in his will.

The testimony of Marsh's private secretary, Joanne Braslow (Anne Archer), reveals that he also had a sexual relationship with her that could have contributed to his death, casting a reasonable doubt as to Rebecca's guilt.

Frank can't resist Rebecca sexually but he doesn't trust her. His wife sees telltale marks on his flesh and realizes he's been having an affair. Rebecca is shown in court to have had previous sexual relationships with a number of older rich men, including Jeffery Roston (Frank Langella), in which her lovemaking was just as rough, indicating that what she did with Marsh was not unusual.

Taking the witness stand, Rebecca's emotional testimony that she did not mean to cause her older lover's death convinces the jury, which acquits her. Before leaving court, she mockingly thanks Frank for getting a guilty client off. Frank finally becomes fully aware that Rebecca indeed killed March delibrately with sex and worse still, he cannot repeat what she said because of the attorney-client privilege law. Frank also knows that Rebecca cannot be tried again because of the so-called "double jeopardy" law which states that no one can be tried twice for the same crime, even if the accused confesses or new evidence surfaces afterwords.

Frank goes that night to Carlson's home, where he finds her with Marsh's doctor, Alan Payley (Jürgen Prochnow), freely discussing the way they both conspired to kill Marsh for his money. She's free and clear, but taunts Payley by telling him to lie low (as he could be convicted of perjury) and to leave because "I've already forgotten you."

Rebecca bluntly tells Frank that her sexual prowess is how she is able to make men do anything... including him. An enraged Payley lashes out at Rebecca physically and, after Dulaney pulls him off, Payley shoots her twice. She plunges from a window to her death in the water below.

In the final scene, as the police take Payley away, Frank turns to Garrett as the dead Rebecca is taken away and says, "You should have won the case Rob." Garrett coldly replies, "I did."

Notes

VersionRun Time
Unrated Edition1:41
R-Rated Version1:39
  • Three versions of this movie have been released: an R-rated theatrical version, a NC-17 version and an unrated video version. European release is the NC-17 cut.

  • The UK video, claimed on the box to be "the full uncut version" shows slightly more graphic footage of the sex scenes than the version featured on the UK region 2 DVDs, as well as American R-rated DVD versions and unrated DVD versions. This is noticeable in the scene where the police "investigators" watch the video tape playing in Andrew Marsh's bedroom after his untimely death and when Rebecca Carlson and Frank Dulaney get personal as well professional for the first time.

  • In both the R and NC-17 rated versions, the infamous candle-wax scene ends with Rebecca putting out the candle, implying she later had sex with Frank. However in the unrated video versions, there is a much longer scene afterwards where Rebecca has rougher sex with Frank.

  • Several explicit scenes were either altered or completely removed for the TV release of the film. This was done to achieve a TV-14 rating for a wider audience.
